PENAMPANG. The
Native Court here said the plaintiff who failed to turn up for the hearing of
her own case has wasted valuable time. Five sisters are involved in a land
subdivision case where four had agreed to the subdivision after the proposed
plan was prepared by a professional surveyor, while one disagreed thus delaying
the new titles of land from being issued by the Lands Department.
The sister who disagreed was the defendant and was
already seated in the dock waiting for the case to be heard.
In accordance with court procedures, three calls were
made for the plaintiff with a court assistant checking outside the main door
for the plaintiff. After about 20 minutes the panel on the bench led by
District Chief Bryan Matasing then adjourned the case indefinitely. He said the
plaintiff who filed for the hearing had signed a copy of the summon for the
defendant but failed to appear and neither called the court to inform of any
unforeseen reasons. As such another scheduled date for case 04/2015 will not be
fixed until the plaintiff appeal for another date and giving acceptable reasons
for not turning up.
