PENAMPANG. A young
husband from Kg. Ketiau told the Native Court here that he no longer love his
wife after the last incident when the wife managed to trace his whereabouts
using iphone5S Finder Apps. He claimed his wife has damaged his car near the
housing estate where his lover was staying, hence he planned to divorce her.
Earlier when the court asked him to confirm whether the
plaintiff is his legal wife, he replied that their marriage is not registered
with JPN (National Registration Department). When the bench said the case is
becoming more serious, he quickly added that their marriage was registered at
the Native Court here in 2014. He said he still love his existing child.
When the court asked him if he loves his girlfriend, he
replied he will marry her “kalau ada jodoh”( if compatible) adding “I am still
not sure, it will all depend on God.”
The hearing was a continuation from 3rd May to
allow his girlfriend who hailed from Membakut, to be present in court. In the
dock, she said she could not attend the previous hearing because she was on
leave attending her father’s birthday party. When asked if the party goes on
from morning to night, she answered with an apology for her non attendance.
When asked to confirm if she is in relationship with the
first defendant, she said “yes since January this year”.
When asked why she is willing to have an affair with a
married man with a family, she answered it was “suka sama suka” ( consensual ).
She added that she loved the man and would marry him
after he converted to her religion of Islam.
She also claimed that the man and herself are not living together at her apartment
In the previous hearing, the wife as plaintiff had
testified that she first discovered the affair between her husband and his girlfriend
by coming across romantic messages in his iphone5S.
The court consisting of District Chief Bryan Matasing,
Native Chief Andrew S Lidaun and KK Charles Abel then adjourned the hearing for
the verdict on 21 June 2016.
