IT is a case of "ada Jodoh" tapi banyak BODOH.......
PENAMPANG. The Native Court here gave a poser whether “suka
sama suka” (mutual affection) has become a trendy excuse to justify
extramarital affairs. Speaking from the bench, the panel of judges comprising
District Chief Bryan Matasing, Native Chief Andrew S Lidaun and Village Chief
Charles Abel said it is a valid reason to get married. However for some couple,
a wayward spouse, usually the husband uses the same excuse when caught with
another woman.
The court then announced the verdict on a young husband
and his lover a total fine or sogit amounting to RM9,000.00 under Section 10 of
Native Court Enactment 1992/1995.
The husband from Kg Ketiau shall give sogit of 2
buffaloes (RM5000) to his wife and one buffalo (RM2500) for appeasement of the
village, plus another RM800 of court cost or 6 months jail in default. His
lover is fined RM700 of the court cost or one month jail in default.
As per standard procedure of the court, the fine shall be
paid within 14 days from the date of verdict. Any party who is not satisfied
with the verdict can appeal to the District Native Court within 60 days.
The court stated all documents submitted, the plaintiff’s
testimony and the admission by both defendants have been thoroughly
investigated in reaching the unanimous verdict.
According to the facts of the case, the wife who has a
baby daughter discovered the affair via messages in iPhone5 belonging to her
husband. She also discovered personal items belonging to the other woman inside
her husband’s car.
Later on she managed to locate her husband using iPhone
finder Apps at the other woman’s apartment. Together with her father the
plaintiff went to find the husband and a confrontation took place where he then
took of the wedding ring and gave it back proposing a divorce.
In response to this the husband said he became angry
because the wife had damaged his car during the argument.
In her concluding statement, the plaintiff said she
waited 6 months hoping to save her marriage before filing the case in court.
Meanwhile in their defence, both the husband and lover
had admitted their mutual affection where he is willing to convert to her religion
to marry her if fated ( “ada jodoh”). He
concluded, “it is up to God” in his final statement before the court.
